Do I need to see a specialist for my personal injury claim to be successful?

For serious injuries, specialist evaluation is both medically appropriate and legally important. Orthopedic surgeons, neurologists, neurosurgeons, pain management specialists, and physiatrists (rehabilitation medicine physicians) provide diagnosis, treatment, and prognosis documentation that primary care physicians typically cannot. Specialist opinions carry more weight in settlement negotiations and at trial because their focused expertise gives their assessments greater authority. From a legal standpoint, specialist records that document the severity of injury, necessity of treatment, permanent impairment, and future care needs are among the most powerful evidence in a personal injury case. Insurance companies routinely dispute the necessity of specialist care in minor cases, but in any case involving significant injury, declining specialist care can both impede your recovery and reduce your settlement. Your primary care physician or emergency physician should refer you to appropriate specialists, and your attorney can often recommend medical providers experienced in evaluating and documenting personal injuries.
