What are my rights if I was injured as a passenger in an accident?

As an injured passenger, you are in one of the strongest positions in a personal injury claim because you are almost never at fault for the accident. You have the right to recover compensation from whichever driver — or drivers — caused the crash, and you do not have to choose between them. If the driver of your own vehicle was at fault, you can file a claim against their liability insurance. If another driver caused the collision, you can pursue their insurer instead. When fault is shared between two drivers, you may file claims against both, and their insurers will apportion responsibility between themselves. Your recoverable damages are the same as any injured party: medical expenses, lost wages, pain and suffering, and future care costs. A common concern is suing a friend or family member who was driving — but in practice you are pursuing their insurance company, not their personal assets. If both drivers are uninsured or underinsured, your own uninsured/underinsured motorist coverage may apply. Consult an attorney to identify every available source of recovery.
