Can I switch personal injury attorneys during my case?
Yes, you have the right to change attorneys at any time during your personal injury case, and doing so does not harm your rights. If you are unhappy with your attorney's communication, progress, or approach, you can discharge them and retain new counsel. Your former attorney may have a lien on your case for the work they performed, which will typically be resolved at the conclusion of the case — but you generally pay no more in total fees than your original contingency percentage. To switch attorneys: consult with a new attorney you want to hire, sign a new representation agreement, notify your former attorney in writing that you are terminating the relationship, and instruct them to transfer your file. Your new attorney will handle the transition and communicate with the former attorney about the lien. If the case is close to a filing deadline, act quickly — transitions take time, and you cannot miss a statute of limitations.
