What is a demand letter in a personal injury case?

A demand letter is a formal written document sent by you (or your attorney) to the at-fault party or their insurance company, formally requesting compensation for your injuries and losses. It typically includes a summary of the accident and how the defendant was negligent, a description of your injuries and medical treatment, documentation of all economic damages (medical bills, lost wages, property damage), a description of your pain and suffering and non-economic losses, the total amount you are demanding to settle the claim, and a response deadline (typically 30 days). The demand letter initiates settlement negotiations and is one of the most important documents in a personal injury claim. A well-crafted demand letter backed by strong supporting documentation demonstrates that you are prepared to pursue litigation and often prompts a serious settlement offer.
