When should I settle my personal injury case versus going to trial?

The decision to settle or go to trial involves weighing several factors. Settlement offers certainty — you receive a known amount without the risk of losing at trial. Trials can produce larger verdicts but also carry the risk of an unfavorable verdict or a reduced award. Settlement is typically faster (months vs. years for trial) and avoids the stress, expense, and publicity of courtroom proceedings. Factors that favor settlement include: clear liability, reasonable offer relative to the value of the case, significant out-of-pocket costs already incurred, and preference for privacy. Factors that favor trial include: an insultingly low offer, strong evidence of severe negligence, significant future damages not being compensated, or a defendant whose conduct warrants punishment through a large verdict.
